Resumo

A interação entre a Governança Ambiental e o Sistema Financeiro Internacional na Agenda Contemporânea aponta para nova forma de conjugar os termos linguagem e comportamento econômico, tema abordado de forma original nos escritos de Deirdre McCloskey na década de 1980. Instituições econômico-financeiras passam a incluir em sua pauta produtivo-financeira o meio ambiente (e.g. lançando pacotes de crédito favorecido a projetos ambientais ou mesmo opondo exigências quanto a práticas ambientais sustentáveis para a concessão de empréstimos). A repercussão para a teoria do direito é sentida a par da substituição de mecanismos tradicionais de sanção (cujo parâmetro fundamental é o da responsabilidade administrativa, civil e penal), por formas alternativas de regulação (como justiça restaurativa e regulação smart).
