The joint curatorship with functional attributions: an instrument for protection of the legally incapable

Curatorship has been a traditional doctrine for the Civil Law since the Roman civilization, and it is still relevant for protecting the interests of those incapable of practicing acts by themselves. As a developing doctrine, is has changed over its evolution, reaching the contemporary paradigm of the best interest of the legally disabled person. Through the analysis of the Roman law, this work intends to identify the conflicts that concerned that legal system and its solutions. As for the contemporary law, the analysis focus on both perspectives of legal decisions and wealth planning, suggesting better arrangements for the future of the disabled person and his or her assets, such as the joint curatorship with functional attributions.
