Abstract

The Law n. 13.019/2014 established a new legal regime to enforce the relationships between de Public Power and the third sector. Among its innovation’s, conceived “Organizações da Sociedade Civil” and set, as a common rule, a public calling procedure to select the third sector partner. The present research seeks to understand, through the review of previous publications, the meaning of “previous accreditation” established at item VI of article 30 as a hypothesis to not enforce the public calling. It also describes and compares how the States and the Federal District regulated this legal provision, analyzing this hypothesis and its enforcement by them.
