The present study is based on the analysis of a judgment of the European Court of Human Rights. The case refers to a citizen of Uganda who, being illegal in the UK, plans to continue living in London for treatment of AIDS. This is the case N. v. United Kingdom, which was tried in 2008, ruled by non-violation of Article 3 of the European Convention on Human Rights (ECHR), based on the understanding that in this case there is no risk of exposure of the applicant to inhuman treatment or degrading treatment
